Florida Workers' Compensation Insurance Fraud Schemes Using Stolen Identities

A growing problem in the workers' compensation insurance industry is use by employees of fraudulent identities, both in support of employment and in support of any subsequent claim for benefits under the provisions of Florida Statute 440. Florida statute 440.105(4)(b) 9 makes it a Felony of the third degree to use false or fraudulent personal identification in order to obtain employment, or support of any claim benefit.

Paying employees under the table is no longer a viable option for employers as there are penalties for either failing to secure coverage, or committing "traditional" premium fraud by paying cash and not reporting it to your insurance carrier. Many times an employee may also be aware of the employer's workers' comp avoidance scheme and they know if they want to be on the payroll that they will need to have a viable identity to use.

As a result a niche business of creating false documents which can be purchased on the black market and used for employment has grown in recent years. Employers are more than ever demanding that any prospective employee possess the documents to pass what is commonly referred to as the "I-9 test", or the IRS Form that verifies that a person is eligible for employment. To that end unscrupulous individuals have made available for purchase fraudulent ID cards, and the most prolific of these fraudulent cards are fake Social Security Card numbers.

One of the main problems with these cards is many times the numbers on the cards actually belong to someone else. While charging identity theft under Florida statute requires knowledge on the behalf of the individual who is using the fraudulent identity
